Clarification Text for the Employee Candidate on the Processing of Personal Data


Dear Employee Candidate;

Hereby this clarification text has been prepared by Asset Medikal Tasarım Sanayi ve Ticaret A.Ş. as the data controller within the scope of Article 10 of the Law on the Protection of Personal Data No. 6698 and “Notification on the Procedures and Principles to be Followed in Fulfilling the Clarification Obligation” in order to inform you on the purposes of processing your personal data, related legal reasons, data collection method, to whom the data can be transferred to and your legal rights under the PDPL.  

We do not have absolute control over the information you have provided on your resumes that were sent to us or on the websites that allowed you to reach us. We recommend that you do not share your personal and sensitive data that you do not want us to know with our Company.
1.    Which Personal Data Do We Process?

•    Your name, surname, date, and place of birth, gender, marital status, nationality;
•    Your e-mail address, home address, mobile phone number;
•    Your health information, if you included it in your resume (such as any possible disabilities);
•    Your education status, your certificate and diploma information, your level of expertise, your foreign language competency, information about your skills, information about seminars and courses you have attended,  information on your computer skills and your exam results;
•    Information on your past work experience (for example, the fields, companies, positions you have worked in, and your past responsibilities and wages)
•    Your photo;
•    Your driver's license information;
•    Information about your hobbies;
•    Your salary expectation;
•    Your military service status information,
•    Your references, (reference person's name, surname, title, workplace, contact information),
•    Other information that you add to your resume voluntarily, which cannot be predicted here; are processed in accordance with the PDPL.
Your relevant data can be stored by Asset Medikal Tasarım San. Ve Tic. A.Ş. for up to 1 year if your job application is not approved, and if it is approved, it can be stored up to 10 years after your employment is terminated.  
2.    For What Purposes Do We Process Your Personal Data?
The personal data mentioned above are processed for the following purposes in order to improve the performance of the Service Agreement regarding the employment service we provide to you:
-    To manage your job application process,
•    To communicate with you,
•    To ensure that you are qualified for the position we will recommend to you,
•    To be able to contact your references and to determine whether you are suitable for the job,
•    To determine the position you want to work in, your salary expectations, whether you can work in other positions or not, and your starting date,
•    To ensure that you are able to operate the company vehicles when the need arises,
•    To determine your suitability for the position that will be offered to you in terms of age and to assure compliance with the "Regulation on the Procedures and Principles of Employing Child and Young Workers"
•    To make sure you can be easily remembered by our human resources unit when you arrive at the interview,
•    To be able to contact the employee candidate and to prepare the personnel file if the employee candidate is accepted to the job,
•    To determine whether you have a situation that may interrupt your employment during the employment contract and comply with the provision of Article 75 of the Military Penal Code No. 1632. 
3.    By Which Method Do We Process Your Personal Data And On What Legal Grounds?
Related personal data are processed automatically (eg. Data sent to our system through the internet) or non-automatically (eg. Recording a piece of information you mentioned on the phone) with your consent and based on the 5th Article of the Law, stating that the process is, (i)”mandatory for the data controller to fulfill its legal obligations” and that, (ii)“the data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned,” and, (iii) the processing of the personal data belonging to the parties to the contract is necessary, provided that it is directly related to the performance of the contract.
4.    To Whom Do We Transfer Your Personal Data And For What Purposes?
The personal data in question may be transferred to the judicial authorities or the relevant law enforcement authorities upon request to resolve legal disputes or in accordance with the relevant legislation.
5.    What Are Your Legal Rights Regarding the Processing of Personal Data and How Can You Access These Rights?
You can submit your requests related to your rights described within the scope of Article 11 of the PDPL,  to ASSED MEDIKAL, in accordance with the Article 5, "Notice on the Procedures and Principles of Application to the Data Controller” in written form or via the registered electronic mail (REM) address, by using a secure electronic signature, mobile signature or the electronic mail address previously notified by the relevant person to the data controller and registered in the data controller's system.
